Tax Treaties for Telangana Businesses and NRIs: US, UK and Gulf Connections
How India's tax treaties come up for Telangana businesses paying foreign vendors, and for the state's large NRI community in the US, UK and the Gulf.
Telangana has deep international connections: Hyderabad's technology and pharma companies work with clients and vendors worldwide, and the state has a large diaspora in the US, the UK and the Gulf. Tax treaties come up constantly — on business payments, and on the income of NRIs with ties to Telangana. This guide covers the common situations.
Telangana Businesses Paying Foreign Vendors
Hyderabad companies regularly pay US and European software, consulting and marketing providers. The India–US and India–UK treaties include a 'make available' concept for technical services, which can take many consulting and service payments outside Indian tax — if the documentation supports it. A TRC, Form 10F and a CA's analysis before remittance are the essentials.
Global Capability Centres
Hyderabad's global capability centres usually receive payments from their foreign parents for services rendered. The treaty questions tend to arise on the other side: payments by the Indian entity to group companies for software licences, royalties or management charges, and the possibility of the parent having a permanent establishment in India.
NRIs With Telangana Income
Many NRIs from Telangana keep property, deposits or businesses in the state. Treaties can affect:
- Tax on interest from Indian deposits, where the treaty rate may be lower than the domestic withholding rate.
- Rental income and capital gains on property, which treaties generally allow India to tax.
- Dual residence, resolved through tie-breaker rules.
NRIs claiming treaty rates need a TRC from their country of residence and Form 10F.
Gulf-based NRIs
Many Telangana NRIs live in Gulf countries with no personal income tax. Indian citizens with Indian income above ₹15 lakh who aren't liable to tax elsewhere can be deemed resident in India — a rule worth checking for Gulf-based NRIs with significant Indian income.
Returning NRIs
NRIs returning to Hyderabad from the US often have US retirement accounts, shares and RSUs. Treaty provisions, residency rules and foreign tax credit interact during the transition.
A Checklist
- For foreign vendor payments, analyse the treaty before remitting.
- Collect TRCs and Form 10F from recipients.
- For NRIs, get a TRC to claim treaty rates on Indian income.
- Gulf-based NRIs: check the deemed residence rule.
- Returning NRIs: plan residency and foreign assets together.
