GST Notices and Appeals in Telangana: State Officers, Appellate Authority and Tribunal
How GST disputes work for Telangana businesses: state or central officers, first appeals in Hyderabad, the Tribunal's state bench, and the Telangana High Court.
The GST dispute process is set by national law, but the officers, appellate authorities and courts that a Telangana business deals with are local. This guide maps them out.
Who Issues the Notice
A Telangana taxpayer is administered by either the Telangana Commercial Taxes Department or the central GST authorities. Scrutiny notices, show-cause notices and orders normally come from the allotted authority. Separately, enforcement and intelligence wings of either administration can act on specific information, including through inspections and searches.
First Appeal
Appeals against orders of officers are filed online in APL-01, within three months, with the pre-deposit. They're heard by the Appellate Authority of the relevant administration — for Telangana-administered taxpayers, the state's appellate officers; for centrally administered taxpayers, the central Commissioner (Appeals) with jurisdiction in Hyderabad.
The GST Appellate Tribunal
The GST Appellate Tribunal has been constituted with principal and state benches, with a bench serving Telangana. Appeals against first appellate orders go to it, with a further pre-deposit. Check the Tribunal's current procedures and timelines when filing, as they've been rolled out in stages.
The High Court
Further appeals on substantial questions of law, and writ petitions in appropriate cases — like breaches of natural justice or orders without jurisdiction — go to the High Court for the State of Telangana.
Common Issues in Telangana Disputes
- Credit mismatches with GSTR-2B, especially from small local suppliers.
- Tax charged under the wrong head — IGST instead of CGST and SGST, or vice versa.
- Construction and works contract rates.
- Export status of services from Hyderabad's IT sector.
- Credit from suppliers later found to be non-existent.
A Checklist
- Check whether you're administered by the state or the Centre.
- Respond to scrutiny notices in full — most disputes can end there.
- Diary appeal deadlines immediately.
- Budget for pre-deposits at each stage.
- Consider writ remedies only for jurisdictional or procedural defects.
