Foreign Tax Credit for Telangana Residents: US Income, RSUs and Returning NRIs
How foreign tax credit comes up for Telangana residents: US-linked income and RSUs, consultants with foreign clients, and NRIs returning to Hyderabad.
Telangana has particularly strong links with the US and other countries: a large tech workforce with foreign-company RSUs, consultants and freelancers working for foreign clients, and many returning NRIs. Foreign tax credit comes up often for these residents. This guide covers the common situations.
Employees With US RSUs
Employees in Hyderabad of US-headquartered companies often receive RSUs. Generally:
- RSUs are taxed in India as salary when they vest, through the Indian employer's payroll.
- US tax may apply in some situations — for example, for periods of work in the US — in which case foreign tax credit may be available in India.
- Dividends on US shares are subject to US withholding, creditable in India within limits.
- Shares held in US brokerage accounts must be reported as foreign assets.
Consultants and Freelancers
Hyderabad's freelancers and consultants often serve clients in the US, UK and elsewhere. Foreign clients sometimes withhold tax. Providing treaty documentation upfront often reduces or avoids that withholding; where it's withheld, credit can be claimed in India with Form 67.
Returning NRIs
NRIs returning to Hyderabad often continue to have income taxed abroad for a while — final salary, retirement account distributions, or rental income from property abroad. During the 'resident but not ordinarily resident' period, much foreign income isn't taxed in India, so credit may not be relevant. Once ordinarily resident, foreign income is taxed in India, and credit for foreign tax becomes important.
Practical Points
- US and Indian tax years differ, so credit is apportioned by period.
- Evidence of US tax — such as tax returns and statements — is needed for Form 67.
- Credit can't exceed the Indian tax on the income.
A Checklist for Telangana Residents
